Como tratado ambiental bajo los auspicios del Programa de las Naciones Unidas, la CMS ofrece una plataforma global para la conservación y el uso sostenible de especies migratorias y sus hábitats. La CMS reúne a los Estados por los que pasan los animales migratorios, los Estados del área, y establece las bases legales para medidas de conservación coordinadas internacionalmente a través de un área de migración.
Como la única convención global especializada en la conservación de las especies migratorias, sus hábitats y sus rutas de migración, la CMS complementa y coopera con varias organizaciones internacionales, ONGs y socios tanto en los medios de comunicación como en el sector empresarial.
Las especies migratorias en peligro de extinción figuran en el Apéndice I de la Convención. Las Partes de la CMS se esfuerzan por proteger estrictamente a estos animales, conservando y restaurando los lugares donde viven, atenuando los obstáculos a la migración y controlando otros factores que puedan ponerlas en peligro. Además de establecer obligaciones para todos los estados miembros de la Convención, la CMS promueve la acción concertada entre los estados del área de distribución de muchas de estas especies.
Las especies migratorias que necesitan o se beneficiarían considerablemente de una cooperación internacional figuran en el Apéndice II de la Convención. Por esta razón, la Convención anima a los estados del área de distribución a crear acuerdos globales o regionales.
A este respecto la CMS actúa como una convención marco. Los acuerdos pueden variar desde tratados legalmente vinculantes (llamados Acuerdos) a instrumentos menos formales, como los Memorandos de Entendimiento, y pueden adaptarse a las necesidades de cada región en particular. El desarrollo de modelos hechos a medida de acuerdo a las necesidades de conservación a lo largo de toda el área migratoria es una capacidad única de la CMS.
