El Memorando de Entendimiento (MdE) sobre la conservación de los tiburones migratorios es el primer instrumento global para la conservación de las especies migratorias de tiburones.
Actualmente, se estima que una cuarta parte de las especies de condrictios están amenazadas en todo el mundo (Dulvy et al. 2014). Los tiburones se encuentran gravemente amenazados en todo el planeta. De acuerdo con estudios científicos recientes (Worm et al. 2013) el número de tiburones que se matan cada año oscila entre 63 y 273 millones de individuos.
El MdE es un instrumento internacional jurídicamente no vinculante. Tiene como objetivo conseguir y mantener un estado de conservación favorable para los tiburones migratorios basándose en la mejor información científica disponible, y teniendo en cuenta el valor socioeconómico de estas especies para las personas en diferentes países.
Actualmente 37 especies de tiburones figuran en el Anexo 1 del MdE.
El Anexo 1 está abierto a la inclusión de otras especies, subespecies o poblaciones migratorias de la clase Chondrichthyes (tiburones, rayas, mantas y quimeras).

En el ejercicio de las actividades descritas bajo estos objetivos, los Signatarios deberían esforzarse en cooperar a través de las organizaciones regionales de ordenación pesquera (OROPs), la Organización de las Naciones Unidas para la Agricultura y la Alimentación (FAO, según sus siglas en inglés), los convenios marinos regionales y los Acuerdos Ambientales Multilaterales (MEAs, según sus siglas en inglés).
La Reunión de los Signatarios (RdS) es el órgano de toma de decisiones del MdE y se encarga de evaluar el estado de conservación de los tiburones migratorios y la implementación del MdE y el Plan de Conservación. El MdE está abierto a la firma de todos los estados del área de distribución de los tiburones migratorios, y también a otros estados y organizaciones regionales de integración económica cuyos buques tienen el potencial de capturar o se dedican a la captura de tiburones migratorios fuera de sus límites de jurisdicción nacional. El número actual de signatarios es 49, incluyendo la Unión Europea.
El Comité Asesor (AC) fue establecido en la Primera Reunión de Signatarios del MdE de los Tiburones (MOS1), y se encarga de proveer asesoría experta y sugerencias sobre nuevas iniciativas y sobre la implementación del MdE a la Secretaría y a los Signatarios.
Quince organizaciones no gubernamentales se han asociado como Socios Cooperantes.
La Secretaría de la CMS, con sede en Bonn, Alemania, actúa como Secretaría del MdE sobre tiburones. Facilita y promueve la realización de actividades de cooperación por parte de los Estados signatarios.
